A mom is suing Sprint and Radioshack after she bought two phones and said her 13-year-old daughter found pornography on them.

Marcia Jones of Lithonia, Georgia, is suing the companies because she said her daughter had to go through counseling after seeing pornographic images on the brand new phone she was activating, WSBTV reported.

According to WSBTV:

Last year, the mother and daughter went to a Radio Shack in Lithonia and bought two HTC Evo 4g phones.

"These were apparently used phones that someone had used. They had used them to upload pornographic pictures," (attorney Curt) Thompson said.

And according to the suit, as 13-year-old Morgan Jones was setting up the phone, she went to the photo gallery and found the pictures including adult and child pornography.

Thompson said the pictures were extremely graphic.

"All the store was willing to do was trade out the phones," Thompson said.

Jones is suing the stores to make sure this never happens again, her attorney told the television station.

The stores do not comment on pending litigation.
